There is a lot of “libel talk” — and filing of mega-million-dollar lawsuits — in the air, and as long as such stays there, the people’s ability to openly criticize public officials is safe.
Advocates of free speech, free press, and holding government publicly accountable — liberals and conservatives alike — need to keep cautious eyes on new, perhaps coordinated, efforts to chill critics and water down legal protections regarding public comments about officials and famous individuals. Can Brennan make a First Amendment case? Yes, to ‘us’
Does former CIA director John Brennan have a First Amendment case against President Trump for pulling Brennan’s national security clearance?
Definitely – in the court of public opinion, if not automatically in a court of law.
Our freedom of speech is most protected when we choose to speak out on matters of public concern; in short, when we join in “political speech.” We are protected against government censorship in advance of such speech, and from government retaliation afterwards, and even – though least often considered – also protected against being forced to speak if we chose not to.

Gene Policinski: ‘Weakening’ libel laws is not the right tactic — for anyone
Making it easier to sue people for libel is not a good idea — for our democracy in general, and even for President Trump and a few of his personal lawyers, in particular.
Trump has railed against existing legal protections, most recently following the publication of journalist Michael Wolff’s searing book “Fire and Fury: Inside the Trump White House.” On Wednesday, Trump said he will take a “strong look” at the country’s libel laws because they are a “sham and a disgrace and do not represent American values and American fairness.”

Memo to Donald Trump: If you find it tough debating opponents named Cruz, Rubio, Kasich and Carson, just wait until you come up against Madison, Jefferson and their crew.
Voters in great numbers certainly approve of your promise to “make America great again.” Well, James Madison, Thomas Jefferson and the other Founders did all that the first time around, at the risk of their lives not primary votes – and in the process made United States the beacon of liberty for the entire world that it remains today.
The founders also enacted a Bill of Rights, with a First Amendment that protects a free press to help keep it that way by serving as a watchdog on government – and on those who would serve in it.
